Welcome to Pecos Automations. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services. By using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our website or services.

1. Overview

Pecos Automations provides AI-driven automation, workflow, CRM integration, and marketing systems—including SMS communications—for businesses. These services may include custom software configuration, technical support, and monthly system management.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use our services. By using Pecos Automations, you represent and warrant that you meet these requirements.

3. User Responsibilities

• Provide accurate and complete information when registering or interacting with us.
• Maintain the confidentiality of any login credentials associated with your account.
• Use our services only for lawful purposes and in compliance with all applicable regulations (including the Telephone Consumer Protection Act, CAN-SPAM, and local data protection laws).

You are solely responsible for the content and legality of any messages, campaigns, or workflows you send or publish using our systems.

4. SMS and Email Marketing Compliance

• You have obtained express consent from all recipients before sending any SMS or email communication.
• You will include appropriate opt-out instructions (e.g., “Reply STOP to unsubscribe”) in all outbound communications.
• You will not send spam, unsolicited messages, or messages in violation of applicable laws.
• You are responsible for maintaining your own recipient consent logs and compliance records.

We reserve the right to suspend or terminate your service for suspected violations of compliance rules.

5. Payment Terms

All service fees are outlined in your client agreement and/or invoice. By purchasing services from Pecos Automations, you agree to:

• Pay all applicable setup, implementation, and monthly recurring fees.
• Authorize recurring billing (where applicable).
• Acknowledge that unused services or early cancellations may not be eligible for refunds unless otherwise specified in writing.

6. Intellectual Property

All content, software, systems, and branding created by or for Pecos Automations remain the sole intellectual property of Pecos Automations. You may not copy, resell, or redistribute any proprietary tools or designs without written permission.

Any assets provided by you remain your intellectual property.

7. Service Availability and Performance

We aim to provide reliable and uninterrupted service but cannot guarantee 100% uptime. You agree that occasional interruptions, delays, or system updates may occur, and Pecos Automations is not liable for damages arising from such interruptions.

8. Termination

We may suspend or terminate your access to services if you:

• Violate these Terms or applicable laws;
• Fail to pay invoiced fees on time;
• Abuse system usage or compromise service stability.

You may terminate services with written notice as outlined in your individual agreement.

9. Limitation of Liability

To the fullest extent permitted by law, Pecos Automations is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services—including loss of data, revenue, or profits.

Our total liability shall not exceed the amount paid by you for services in the prior three (3) months.

10. Modifications

We may update these Terms from time to time. Any changes will be posted to this page with a new “Last Updated” date. Your continued use of the services after such changes constitutes acceptance of the new terms.

11. Governing Law

These Terms are governed by the laws of the State of Texas. Any legal action or proceeding must be brought in Fort Worth, Texas.
